Information about our Services The developer of Journale (“Journale”) provides you with access to and use of its applications, features, software, web platforms, and associated services (“Services”), in accordance with these Terms. Privacy and security principles Since its inception, Journale has been developed under strict privacy and security principles. Communication with other users We constantly facilitate and improve the sharing of content between people through images, videos, texts, and comments in posts or digital newspapers created by our users. Continuous improvement We analyze app usage to improve our features, performance, and security. We may work with partners and providers for these purposes. Interaction with businesses Journale may facilitate the sharing of digital content between users and organizations for transactional information, notifications, promotions, or other commercial interactions. Security and integrity We reserve the right to act against abusive, illegal behavior or behavior that violates these Terms. Global infrastructure Our Services may be operated through servers distributed across different regions of the world. Affiliate companies Journale may share information with its affiliates and technology partners as stipulated in the Privacy Policy. Emergency services Journale does not provide access to emergency services. You must ensure you have other means to contact firefighters, police, or hospitals. General rules You must use Journale legally, as authorized, and in accordance with these Terms. We reserve the right to suspend or terminate accounts that violate these rules. It is prohibited to: - Violate privacy or intellectual property rights. - Promote hate, violence, or illegal behavior. - Impersonate others. - Send spam, automated or bulk messages without permission. - Interfere with platform operation. - Distribute malware or viruses. - Collect user information without authorization. - Sell, sublicense, or replicate our services without permission. Account security You are responsible for the use of your account and device. Notify us of unauthorized access. Third-party services Journale may integrate with external services such as cloud storage, UI libraries, maps, among others. The use of these services is governed by their own privacy policies. Licenses Your rights You retain ownership of the content you upload or send through Journale, but you must have the rights to do so. Journale's rights Journale retains all intellectual property rights over its brand, logos, interfaces, and software. License you grant us By using our Services, you grant us a worldwide, non-exclusive, sublicensable, royalty-free license to use, store, and transmit your content in order to operate the platform. License we grant you We grant you a limited, revocable, and non-exclusive license to use the app in accordance with these Terms. Reporting rights violations You may report intellectual property violations by writing to support@journale.app. We reserve the right to remove content or accounts depending on the severity or repetition of the violation. Disclaimers and exclusions of liability You use Journale at your own risk. We do not guarantee continuous or error-free operation. We are not responsible for the content or behavior of other users. Limitation of liability Our liability is limited to the greater of 100 USD or the amount you have paid in the last 12 months. This limitation applies to the maximum extent permitted by law. Indemnification You agree to indemnify and hold Journale harmless from any claim arising from misuse of the Services or breach of these Terms. Dispute resolution Jurisdiction All disputes will be resolved in the competent courts of Bogotá, Colombia, unless otherwise stated in the following section. Governing law These Terms are governed by the laws of the Republic of Colombia. Time limit You have up to one (1) month to file any claim related to the use of our Services. Availability of our Services Journale may suspend, modify, or remove features at any time. Likewise, it may cancel inactive accounts or in case of violations. Other provisions These Terms constitute the entire agreement between you and Journale. You may not transfer your rights without our consent. We reserve the right to assign our rights to third parties. If any clause is invalid, the others will remain in effect. These Terms may be updated. By continuing to use the app, you accept the modified versions. Special arbitration provision for users in the United States or Canada If you reside in the U.S. or Canada, you agree to resolve all disputes through binding individual arbitration, except those related to intellectual property. Federal Arbitration Act This agreement is governed by the U.S. Federal Arbitration Act. Procedure Before initiating arbitration, you must send us a notice including: - Your full name and address. - Email or number used in Journale. - Description of the dispute. - Requested compensation. Opt-out You may opt out of this arbitration clause by sending a letter within 30 days of your registration to: Journale – Arbitration Opt-Out Cra 8 #96-47, Office 201, Bogotá, Colombia Include your name, address, and a statement of rejection. Small claims court You may use small claims courts if allowed by local law. No class actions You agree not to participate in class actions or representative actions against Journale.
