The developer of Journale (“Journale”) provides you with access to and use of its applications, features, software, web platforms, and associated services (“Services”), in accordance with these Terms.
About the services
- Journale facilitates the sharing of images, videos, texts, and comments between users.
- We analyze usage to improve features, performance, and security.
- We may facilitate interactions between users and organizations for notifications, promotions, or transactional information.
- Our services may operate through infrastructure distributed across different regions.
- Journale does not provide access to emergency services.
Acceptable use
You must use Journale legally, as authorized, and in accordance with these Terms. We may suspend or terminate accounts that violate these rules.
It is prohibited to:
- Violate privacy or intellectual property rights.
- Promote hate, violence, or illegal behavior.
- Impersonate others or collect user information without authorization.
- Send spam, automated, or bulk messages without permission.
- Interfere with platform operation or distribute malware.
- Sell, sublicense, or replicate our services without permission.
Accounts, third parties, and licenses
You are responsible for the use of your account and device, and you should notify us of unauthorized access. Journale may integrate with external services whose use is governed by their own terms and privacy policies.
You retain ownership of the content you upload, but you must have the rights to do so. Journale retains all intellectual property rights over its brand, logos, interfaces, and software.
By using our Services, you grant Journale a worldwide, non-exclusive, sublicensable, royalty-free license to use, store, and transmit your content in order to operate the platform. In turn, we grant you a limited, revocable, and non-exclusive license to use the app in accordance with these Terms.
Reporting violations
You may report intellectual property violations by writing to support@journale.app. We reserve the right to remove content or accounts depending on the severity or repetition of the violation.
Disclaimers and limitation of liability
You use Journale at your own risk. We do not guarantee continuous or error-free operation and are not responsible for the content or behavior of other users.
Our liability is limited to the greater of 100 USD or the amount you have paid in the last 12 months, to the maximum extent permitted by law. You agree to indemnify Journale against claims arising from misuse of the Services or breach of these Terms.
Disputes and governing law
Unless otherwise stated, disputes will be resolved in the competent courts of Bogotá, Colombia, under the laws of the Republic of Colombia. You have up to one month to file any claim related to the use of our Services.
Journale may suspend, modify, or remove features at any time, including canceling inactive accounts or accounts that violate these Terms.
Special arbitration provision for users in the United States or Canada
If you reside in the U.S. or Canada, you agree to resolve disputes through binding individual arbitration, except for intellectual property matters. Before starting arbitration, you must send a notice with your identifying information, dispute description, and requested compensation to Cra 8 #96-47, Office 201, Bogotá, Colombia.
You may opt out of this arbitration clause by mailing an opt-out notice within 30 days of registration. Where permitted by local law, you may still use small claims court. No class actions or representative actions are allowed against Journale.
